CRIS ERICSON SPOKE AT THE BEGINNING OF THE MEETING
on Aug. 29, 2012 and again at the end, and submitted notes.
Herein is Cris Ericson's PUBLIC COMMENT on the proposed
biomass plant in N. Springfield, Vermont.
(PART 1) ADDRESSING THE
AMERICANS WITH DISABILITIES ACT,
(PART 2) PRESENTING AN ALTERNATIVE PROPOSAL:

(PART 5 Addressing the fact that Governor Peter Shumlin
was never legally elected, Deborah Markowitz was
not legally appointed, and all of the actions of the
Vermont Agency of Natural Resources are therefore
illegal and can be voided and rescinded in Federal Court.

(1) A Biomass plant affects commerce and provides electricity,
a public accomodation.

Public Accomodations with Obligations
is a facility either privately owned or leased or operated
and whose operations
affect commerce (by creating and selling electricity)
Title III protects individuals with physical health problems that limit
major life activities, such as breathing.
I have a friend, Stan Rabtoy, who is a senior citizen and uses an oxygen
tank, and he lives on Stoughton Pond Rd., south of Stoughton Pond,
which is part of the N. Springfield Recreation Area, and he's about
2 miles north of the proposed Biomass plant.
Section III 4.2100
28 CFR 36.301-36.310
A public accomodation must reasonably modify its policies, practices or
procedures to avoid discrimination.
For example,
a company says that all reasonably healthy adults can climb the stair case.
There is only one person in town who uses a wheel chair.
The company must install a wheel chair ramp.
Therefore, if the proposed Biomass plant operator claims
that reasonably health individuals can breathe polluted air
and particulate matter,
even if there is only one disabled person using an oxygen
tank who cannot breathe particulate matter even with the oxygen tank,
then they must modify the plant design, the carbureator or
fuel injector system, to be 75% efficient or better.
If they can not, then they can not build the proposed plant here.
Title III-5.0000 New Construction
28 CFR 36.401; 36.406; Appendix A
All newly constructed places of public accomodation
(a biomass plant that sells electricity to the grid)
must be usable by individuals with disabilities.
If a person with a breathing problem with ashtma, or who needs
an oxygen tank, will die from the particulate matter,
then they can't use the electricity if the making of the
electricity kills them.
There is no cost defense to new construction requirements.
Whenever the U.S. Department of Justice has reasonable cause to
believe that there is a pattern or practice of discrimination
that raises an issue of general public importance, the U.S. DOJ
will investigate complaints and conduct compliance reviews;
all you have to do is submit a complaint.
Complaints against Winstanley Enterprises for proposing to harm
disabled persons with a biomass plant that will sell electricity
to the grid and is therefore a public accomodation that falls
under the federal ADA,
can be sent to:

Under the federal ADA, the State of Vermont is not immune
from an action in Federal Court for violations,
or conspiracy to commit violations of the ADA.
Title II covers programs, activities and services
of public entities.
Subtitle A is intended to protect qualified individuals with
disabilities from discrimination on the basis of disability
in the services and programs or activities
of all State and Local Governments.
28 CFR 35.104 (remember, Federal law pre-empts and trumps state laws)
The State of Vermont must demand that Winstanley Enterprises
modify the design of the proposed Biomass plant so that it is
at least 75% efficient, or they must deny all permits for the plant
because it is a new construction of a biomass plant that wil sell
electricity to the grid, it is therefore a public accomodation,
and under Title II the State of Vermont is liable if they
do not prohibit the Biomass plant because it will discriminate
against disabled persons because it will kill some of them, some of
those with asthma and some of those who use oxygen tanks,
and becuase they cannot build the equivalent of a wheel chair ramp,
in the example where if healthy people can climb stairs,
the State of Vermont under Title II is still required to
demand the facility build a wheel chair ramp for disabled person -
so using that example, the State must require the equivalent
of a wheel chair ramp, which would be to modify the design
to at least 75% efficiency, and if that can not be done,
to provide a reasonable accomodation under the ADA which
would be to deny all permits for the proposed plant.

PART 2
If Adam Winstanley cannot modify the carbureator or fuel injector
system of the biomass plant to improve the efficiency to at least
75%, then he should use the property in N. Springfield to
start "Winstanley Winery" and buy apples and strawberries and
blueberries and organic thyme flowers and organic mint flowers
and organic oregano flowers and dandelions and sandy rose
hedge rose hips from local gardeners and farmers and create
jobs and create a 100% pure Vermont winery of specialty wines
and sell them worldwide to tourist resorts and create a substantial
business that local residents can contribute to and be proud of.

Need Bald Eagle Critter Cam Advice in WINDSOR COUNTY, Vermont!!!

I am one of the speakers who spoke up at a meeting
Aug. 29, 2012, televised on http://www.sapatv.com
opposed to the proposed Biomass plant
which would pollute the air, and harm the water the
American Bald Eagles fish in at Stoughton Pond which
is part of the N. Springfield Recreation Area.

I live 11.6 miles from the road entry of Stoughton Pond
but much closer as birds fly.
One of the other women at the meeting, Louise Peal,
suggested I contact you and ask you to help us.
There is no respect for the very few American Bald Eagles
in Vermont because the Agency of Natural Resources cares
more about creating electricity, which obviously proves
they are a corrupt bunch of people who should be investigated
for the possibility that the proposed Biomass company
is paying them off under the table to allow the
environmental rape of Vermont.
We were thinking that because you are experienced with
Critter Cams, that maybe you could apply for emergency
federal funding for your group to visit Vermont and
set up a Critter Cam to follow the American Bald Eagles
living at Stoughton Pond.
There are only a few Bald Eagles in Vermont.
Please help us so the environmental rapists who would
"strip mine" Vermont of trees
won't take their Bald Eagle homes away, pollute the air we breathe
with them, and pollute Stoughton Pond which is their
source of fish.

PART 5
GOVERNOR PETER SHUMLIN OF VERMONT WAS NEVER LEGALLY ELECTED AND
HIS APPOINTMENT OF DEBORAH MARKOWITZ TO THE AGENCY
OF NATURAL RESOURCES IS NOT LEGAL AND THEREFORE CAN
BE RESCINDED AND VOIDED IN FEDERAL COURT.
"Governor" Peter Shumlin of Vermont,
a Democrat, allegedly is a "fraud", and after
having allegedly rigged the vote count, he allegedly paid
off the Vermont Secretary of State, Deborah Markowitz,
who allegedly changed the actual vote count,
by giving her a high paid appointed position.
They haven't been charged with any crime.
Is Vermont more corrupt than any other state,
so corrupt that alleged crime can go publicly
rewarded?
Thousands of votes were allegedly stolen
from candidate Cris Ericson,
which you can see by the difference in
the unofficial election results
collected, and then the official results
released to the news media.
Once the unofficial results were tabulated,
it was clear that no candidate
had received a majority of the vote.
Under Vermont law, when that happens,
the full state legislative body
must vote on a ballot with the names
of the three candidates who
received the most votes.
By changing the vote count, instead
of Cris Ericson's
name being on that ballot,
Dennis Steele's name was listed.
If Cris Ericson's name
had been listed, then some of the
state legislators
may have voted for her, and that may
have changed the outcome,
giving the most votes for Governor
to the Republican candidate, Brian Dubie.
Cris Ericson
would not have won, but by allegedly
stealing votes from
her, and not putting her name on
the ballot the full state legislative
body was required to vote on because
no candidate received a
majority of the vote, the correct
outcome is unknown.
Unless the stolen votes are recovered
by finding out who may have
hacked into the system, who may
have been paid off, and who may
be guilty of alleged voter fraud,
it is not appropriate or legally correct
allegedly, for Peter Shumlin to
act as Governor of Vermont.
The person or persons who allegedly
committed this voter fraud
should be discovered and then
the full state legislature should
be required to vote again for Governor
because no candidate
received a majority of the vote, and
the vote that was taken
by the state legislative body was
allegedly based on voter fraud.
Just look at the difference in the two
vote counts from unofficial,
when someone realized no candidate
had a majority of the vote,
to the official results which give an
allegedly weaker candidate the third place.

Deborah Markowitz (Democrat) was
Secretary of State at the time and in control,
and
therefore she allegedly should be charged
with vote fraud for cutting Cris Ericson's votes for Governor
and for U.S. Senate in half! Cris Ericson was on the ballot
for both offices.
Peter Shumlin (DEMOCRAT) allegedly rewarded
Deborah Markowitz (DEMOCRAT) for her alleged
vote fraud by giving her an extremely
high paying job in his administration,
which she now holds.
Are Peter Shumlin (DEMOCRAT) and Deborah Markowitz (DEMOCRAT)
criminals, and if so,
under what federal codes and statutes?
